Evening Meeting: Costly Conversations – a review of recent developments in competition law applying to information exchange

Panel: Matthew Byford, Ofcom, Josh Holmes KC, Monckton Chambers and Helen Fairhead, Norton Rose Fullbright

The panel moderated by Kim Dietzel will consider Ofcom’s Motorola/Sepura infringement decision dealing with a ‘costly conversation’, as well as the information exchange issues that featured in the Phones4U trial.  It will also touch on the amended EU Horizontal Guidelines (with their revised chapter on information exchange, which expands on a range of concepts and types of information sharing including hub-and-spoke arrangements, public announcements, data sharing and collaboration through algorithms), asking itself the question at what point transparency tips into anti-competitive information exchange.
